FargoTube Privacy Policy Updated April 30, 2010

The F3 Technologies Inc., Privacy Policy (“Privacy Policy”) describes how F3, its directors, employees, agents, and subsidiaries treat personal information when you use F3 services, but not limited to, FargoTube.

PERSONAL INFORMATION

• Usage Information. When you use FargoTube, we may record information about your usage of the site, such as your browsing, searching, or viewing history, the channels, groups and favorites you subscribe to, which other users you communicate with, the videos you watch or download, the frequency and size of data transfers, and information you display about yourself as well as information you click on in FargoTube (including user interface elements). If anyone is logged in through your account, we may associate that information with your FargoTube Account and the information we collect is used to improve the content of our Web pages and the quality of our service. For this reason, we strongly suggest that you protect your login and password and that you not share them with others. We also collect the e-mail addresses of those who communicate with us via e-mail, aggregate information on what pages consumer's access or visit, and information volunteered by the consumer (such as survey information and/or site registrations). The information is not shared with or sold to other organizations for commercial purposes, except to provide products or services you've requested, or when we have your permission. We may use your email address to send you information about F3, FargoTube, new products or services offered by F3 as they are developed.
  
  We also share information about you and the use of your account when necessary in order to investigate, prevent, or take action regarding illegal activities, suspected fraud, situations involving potential threats to the physical safety of any person, violations of Terms of Service, or as otherwise required by law. We produce information when requested by a subpoena from a Court of competent jurisdiction. We cooperate fully with law enforcement authorities. Your agreement to the Privacy Policy and your use of FargoTube expressly authorizes FargoTube and F3 to release your personal information in the course of such investigations. We transfer information about you if F3 Technologies or Interaction is acquired by or merged with another company. In this event, F3 Technologies will notify you before information about you is transferred and becomes subject to a different privacy policy.
• Content Uploaded to Site. Any personal information or video content that you voluntarily disclose online (e.g., video comments, your profile page) may be collected and used by others. We have no control over personal information that you choose to upload and share with others or with third party dissemination of your information that you provide for public viewing via FargoTube.
• Browsing FargoTube. You can watch videos on FargoTube without having a FargoTube Account. You also can contact us through the FargoTube Help Center or by emailing us directly without having to register for an account.
• FargoTube Account. For some activities on FargoTube, like uploading videos, downloading videos, subscribing to Tubes, rating videos, rating Tubes, posting comments or flagging videos, you need a FargoTube Account. When you create an account on FargoTube, you are required to provide us with certain personal information, including your email address and a password, which is used to protect your account from unauthorized access. You have the responsibility of keeping your email address and password and other FargoTube account information confidential.

PUBLIC INFORMATION

• When you create a FargoTube Account, some information about your FargoTube Account and your account activity will be provided to other users of FargoTube. This may include the date you opened your FargoTube Account, the date you last logged into your FargoTube Account, your age (if you choose to make it public), the country and the number of videos you have watched.
• When you create a Fargo Tube account, you will select an Account Name. Your FargoTube Account name is displayed to other users when you engage in certain activities on FargoTube, such as when you upload videos or send messages through FargoTube. Other users can contact you by leaving a message or comment on the site.
• Any video content that you submit to FargoTube may be redistributed through the internet and other media channels and may be viewed by other FargoTube users or the general public. FargoTube has no ability to prevent third parties from using the content of any video that you choose to upload for viewing. You are responsible for securing and trademark, copyright, or other intellectual property ownership interest you may have in any uploaded video content, and you are responsible for enforcing any rights you may have in such content against third parties.
• You may choose to add personal information to your Account profile, which may include your name, gender, profile picture or other details, that will be visible to other users on your FargoTube Account, Channel page or Private Tube. If you choose to add certain features to your FargoTube Account channel page or Private Tube, then these features and your activity associated with these features will be displayed to other users and may be aggregated and shared with your friends or other users. Such shared activity may include your favorite videos, videos you rated and videos that you have uploaded.

MyAccount OPTIONS

• If you have a FargoTube Account, you may update or correct your personal profile information, email preferences and privacy settings at any time by visiting your MyAccount page.
• You may control the information that is available to other users and your confirmed friends at any time by editing your FargoTube Account and the features that are included on your channel or private tube page.
• You may, of course, choose not to submit personal information through FargoTube, in which case you can still view videos and explore FargoTube, but FargoTube may not be able to provide certain services to you.

INFORMATION GATHERING AND USAGE

• When you register for FargoTube we ask for information such as your name, email address, billing address, and credit card information. F3 Technologies uses collected information for the following general purposes: products and services provision, billing, identification and authentication, services improvement, contact, and research.

ADVERTISING ON FARGOTUBE

• FargoTube makes every effort to provide you with advertising that is appropriate for your demographic, and we use the cookies, as well as other third party ad serving systems, to do so. We may use a range of information including cookies, web beacons, IP addresses, usage data and other non-personal information about your computer or device (such as browser type and operating system) to provide you with relevant advertising. If you are logged into your FargoTube Account, we may also show you advertising based on the information you have provided to us in your FargoTube Account or which is based on your viewing, uploading, and downloading habits, along with those of the persons with whom you communicate via FargoTube.
• Advertisers may serve ads based on interests associated with non-personally identifiable online activity, such as videos viewed, frequency of uploading or activity on other partner sites. Advertisers may also serve ads to you based on previous activity on that advertiser's website. This non-personally identifiable information is held separately from your YouTube Account data, or other personally identifying information in our possession.
• FargoTube does not provide any personal information to third-party ad servers or ad networks without your consent. You should consult the respective privacy policies of these third-party ad servers or ad networks for more information on their practices and for instructions on how to opt-out of certain practices. FargoTube's privacy policy does not apply to, and we cannot control the activities of, such other advertisers or web sites. Any data obtained by third-party ad servers subsequently shared with FargoTube is maintained and dealt with by us in accordance with this privacy policy.

COOKIES

• A cookie is a small amount of data, which often includes an anonymous unique identifier, that is sent to your browser from a web site's computers and stored on your computer's hard drive. Cookies are used for performance and management of sub-domains and other administrative functions. We use cookies to record current session information, but do not use permanent cookies. You are required to log-in to your FargoTube Site after a certain period of time has elapsed to protect you against others accidentally accessing your account contents.

DATA STORAGE

• F3 Technologies uses third party vendors and hosting partners to provide the necessary hardware, software, networking, storage, and related technology required to run FargoTube. Although F3 Technologies owns the code, databases, and all rights to the FargoTube application, you retain all rights to your data.

DISCLOSURE

• F3 Technologies may disclose personally identifiable information under special circumstances, such as to comply with subpoenas or when your actions violate the Terms of Service.

CHANGES

• F3 Technologies may periodically update this policy. We will notify you about significant changes in the way we treat personal information by sending a notice to the email address specified in your FargoTube account or by placing a prominent notice on our site.
